Welcome to TubeInsights. These Terms of Service ("Terms") constitute a legal agreement between you and TubeInsights ("Company", "we", "us", or "our"). By accessing and using https://tube-insights.com (the "Website") and our services (the "Services"), you agree to be bound by these Terms and our Refund Policy.

1. Acceptance of Terms

By using our Services, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services. We reserve the right to modify these Terms at any time, and your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

2. Payment Processing and Third-Party Services

TubeInsights uses Paddle as its payment processor. By making a purchase, you agree to the Paddle Checkout Buyer Terms, which are incorporated into and form part of this agreement. All purchases are subject to both these Terms and Paddle's terms and conditions.

3. Use License

Permission is granted to temporarily download one copy of the materials (including information and software) from TubeInsights for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on the Website or Services
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server
• Use the Services for any purpose that is illegal or prohibited by these Terms
• Use automated systems to access the Services without prior written permission
• Use the Services to violate YouTube's Terms of Service, including unauthorized scraping or collection of YouTube data
• Access or analyze YouTube data in violation of YouTube's API policies or without proper authorization

4. Subscriptions and Auto-Renewal

By subscribing to TubeInsights, you authorize automatic recurring billing at the interval and price you selected (monthly, annually, etc.). Your subscription will automatically renew at the end of each billing period unless you cancel.

To Cancel Your Subscription: You must contact us at tubeinsights47@gmail.com or through your feedback menu at least 48 hours before the end of your current billing period to avoid renewal charges. Cancellations requested after this deadline will be processed with the next billing cycle.

When you cancel, your access to the Services will continue until the end of your current billing period.

5. Digital Services and Content Processing

TubeInsights provides digital video analysis services. Once you upload videos for analysis and processing has begun, the service is considered accessed and cannot be cancelled or refunded.

You retain ownership of your videos, but grant TubeInsights the right to process, store, and analyze them for the duration of your subscription. All video data is subject to our Privacy Policy.

6. Refund and Cancellation Policy

Our complete refund and cancellation policy is available in our separate Refund Policy document. By accepting these Terms, you also agree to our Refund Policy, which outlines your consumer rights, refund eligibility, and the procedures for requesting refunds or cancellations.

7. Payment Methods and Restrictions

TubeInsights accepts multiple payment methods processed through Paddle, including credit cards, debit cards, and PayPal. Payment processing typically occurs within 24-48 hours.

Wire Transfer Orders: Orders placed via wire transfer or bank transfer are not eligible for refunds, cancellations, or consumer protection coverage. We recommend using credit/debit cards or PayPal to ensure consumer protection.

8. Disclaimer

The materials on TubeInsights's Website and Services are provided on an 'as is' basis. TubeInsights makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitations

In no event shall TubeInsights or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on TubeInsights's Website and Services, even if TubeInsights or an authorized representative has been notified orally or in writing of the possibility of such damage.

10. Accuracy of Materials

The materials appearing on TubeInsights's Website and Services could include technical, typographical, or photographic errors. TubeInsights does not warrant that any of the materials on our Website are accurate, complete, or current. TubeInsights may make changes to the materials contained on our Website and Services at any time without notice.

TubeInsights has not reviewed all of the sites linked to its Website and Services and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by TubeInsights of the site. Use of any such linked website is at the user's own risk.

TubeInsights may revise these Terms of Service for our Website and Services at any time without notice. By using this Website and Services, you are agreeing to be bound by the then current version of these Terms of Service.

13. User Accounts

When you create an account on our Services, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify TubeInsights immediately of any unauthorized use of your account.

14. User-Generated Content

By submitting content to TubeInsights, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, adapt, and publish the content. You represent and warrant that you own or have the necessary rights to submit the content and that the content does not violate any third-party rights.

15. Intellectual Property Rights

All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Website or Services, is the property of TubeInsights or its content suppliers and protected by international copyright laws.

• Initiating chargebacks or payment disputes without first attempting resolution with TubeInsights
• Abuse of our Services or engagement in prohibited activities

Repeated chargebacks or payment disputes without attempting to resolve issues directly with us may result in permanent termination and prohibition from using TubeInsights services.

20. Governing Law and Dispute Resolution

These terms and conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

Payment-related disputes are also governed by Paddle's terms and conditions. In case of disputes regarding payments or refunds, Paddle's determinations will be binding.
